Civil action


Civil action - prosecution in criminal proceedings aimed at settling civil liability of the accused.

In older literature, civil action was used as a synonym of the adhesion process.

A civil action is beneficial for both the justice and the accused and the injured. A civil action is beneficial to the judiciary, because two types of liability are dealt with by one court. For the injured person, because he does not have to face two courts, the other one is responsible for the same process, and therefore he is exposed to lower court costs. According to the Polish Code of Civil Procedure, a judgment in a criminal court is binding on a court in a civil procedure (Article 11, paragraph 1).
