Common property


Common property - property acquired during the matrimonial property of either spouse, or only by one of them, and not belonging to personal property. Property acquired in this way becomes co-ownership of both spouses.

The term "property" includes property rights such as property and other property rights, as well as claims. This will also mean legal situations such as ownership or expe- rience.

The legal basis for the separation of common property is art. 31 of the Family and Guardianship Code. According to this provision, common property includes, in particular, the remuneration received for work and income from other gainful activities of each spouse, the income from the common property as well as the personal property of each spouse and the funds deposited on the account of the open or occupational pension fund of each spouses.
