affirmative action


Actio confessoria - a lawsuit brought by the Roman court to protect servants. The pre-fine law was referred to as vindicatio servitutis. Justyinian codification has become the only way to protect all servility (personal and land). Characteristics of the action

The action was of a substantive nature. It obliged the person entitled to use the thing burdened with easement. The defendant may have been a person who denied the existence of the easement or was unable to do so.
