action noxalis


Actio noxalis - in Roman law an action of a victim against a superior of a delinquent or slave owner of a slave if he was a slave. Characteristics of the action

The action was in personam - the defendant could only be the person under whose authority the perpetrator was present (noksal responsibility). The suit was ordered to pay damages by the defendant and the fine (actio mixta). The defendant could, however, be released from liability by giving the injured person a delicacy in the mancipus until the damage is done.
