EU anti-dumping measures


The European Union anti-dumping measures are in addition to the anti-subsidy measures and protection measures against the excessive importation of safeguard measures by the European Union. They are the most commonly used measures, as more than 80% of market protection measures are anti-dumping measures. Anti-dumping measures may be imposed only after appropriate action (up to fifteen months) by the European Commission instituted at the request of the injured EU industry or ex officio. The purpose of the proceedings is to show that four conditions have been met:

The conduct of the proceedings consists in sending out questionnaires, then analyzing the information received in this way and attempts to supplement them. The European Commission also conducts on-the-spot verifications and hearings. If the European Commission finds that all of these have occurred, it recommends the imposition of appropriate anti-dumping measures. The proposal is consulted with the Member States and the Anti-Dumping Committee of Experts and finally voted in the Council of the European Union.

The definitive anti-dumping duties imposed in this way apply to all imports of a particular product from the country concerned (except for exporters who have placed a price undertaking). The standard duration of the anti-dumping duty is five years, renewable at the request of the EU industry concerned and suspended if the supply of the product concerned is found to be insufficient on the European Union market.

The value of the anti-dumping duty is fixed in the European Union by the lesser duty rule.

When prompt action is required, the European Commission may impose provisional duties during the anti-dumping proceeding. The importer shall then submit to the bank the amount of the security corresponding to the amount of the provisional duty which will only be collected if the protective measures are necessary. It is usually imposed for a period of six months.
