By reservation, the signatory State states that it refuses to recognize binding provisions of this Agreement or to modify the legal effects of such provisions in its application.

Vienna Convention on the Law of Treaties in art. 19 provides:

When signing, ratifying, accepting or approving a treaty and upon accession, the State may raise a reservation unless: (a) the reservation is prohibited by the Treaty; (b) the Treaty states that only certain reservations may be made and that the objection does not concern them, or c) cases not covered by subparagraphs (a) and (b), and the objection is inconsistent with the object and purpose of the treaty.

The consequences of objection and opposition to it and their withdrawal are discussed in Articles 20 to 23. Art. 20 states:

1. A reservation expressly granted by the Treaty does not require any subsequent adoption by the other Contracting States unless the Treaty so decides. 2. Where, from a limited number of negotiating States and from the subject-matter and purpose of the Treaty, the application of the treaty in its entirety between all parties is an essential condition for the consent of each of them to be bound by the Treaty, the reservation is required by all parties. 3. When a treaty is a constitutional act of an international organization, the reservation must be accepted by the competent organ of that organization, unless the treaty decides otherwise.

The reservation, its adoption and the opposition must be made in writing and communicated to the Contracting States and entitled to accede to the Treaty (Article 23).

Example of admissibility:

(a) areas for which the provisions of the Convention have not been amended;

(b) the areas where it is committed to apply the provisions of the Convention as amended and to which these modifications relate;

(c) areas where the Convention can not be applied and in which cases the reasons for which it can not be applied;

d) areas for which it reserves a decision.

These objections may then be withdrawn.
