Actio ex testamento - Roman lawsuit against the heirs of the legatee (s) against the heirs for the payment of the bribe. Characteristics of the action
Under the legate, a legate may have demanded from the heirs of a thing written in his will. In the case of a legate, this may have been part of the inheritance, the inheritance of the estate, or even the property of a third party. In the latter case, the heirs were obliged to insist on having their property inscribed or pay the equivalent of the levies. This ratio was included in the obligations of the contractes quasi ex contractu because the heir with the registrar did not join the contract, nor did the relationship arise because of an unlawful act.
The protection of the legatee's claims was served by actio ex testamento belonging to the actiones in personam. Bibliography
