Invalidity - type of sanction provided for by law (legal sanction) as a consequence of defect, ie failure to comply with the provisions of law. As a rule, nullity is supposed to result in the removal of a defective legal action, an administrative decision, a court judgment, an international agreement, etc. from the legal market. The effect is then ex tunc (backward), ie from the moment of action (issuing the decision, judgment, etc.). affected by a defect (a condition for nullity). In its less categorical form - the relative nullity (ex nunc) - does not lead to automatic but to the rebelliousness, that is, the possibility of invoking the defect and bringing about the annulment.
